1. Agreement to Terms
By accessing or using Chisel ("the Service"), operated at getchisel.app, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Chisel is a project management and customer relationship platform designed for general contractors and small construction crews. Features include lead tracking, project management, customer communication via SMS, invoicing, estimates, photo documentation, scheduling, and a customer-facing project portal.
3. Accounts
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activity that occurs under your account
- You must be at least 18 years old to create an account
- One person or business per account — accounts are not transferable
4. Subscription & Billing
Chisel offers a 14-day free trial. After the trial period, a paid subscription is required to continue using the Service. Subscriptions are billed monthly via Stripe.
- You can cancel your subscription at any time from your account settings
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial billing periods
- We reserve the right to change pricing with 30 days' notice
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Send unsolicited or spam SMS messages through the platform
- Upload malicious files or attempt to compromise the Service
- Share your account credentials with unauthorized users
- Reverse-engineer, copy, or resell any part of the Service
- Use the SMS features for marketing, advertising, or any purpose other than direct project-related communication with your customers
6. SMS Messaging Terms
Chisel provides SMS messaging features powered by Telnyx. By using these features, you agree to the following. For complete SMS program details, see our SMS Messaging Terms page.
For Contractors (Account Holders)
- You are responsible for obtaining proper consent from your customers before sending them SMS messages, via the Chisel consent form or documented verbal/written consent
- You will only send messages that are relevant to active projects
- You will honor all opt-out (STOP) requests promptly
- You are responsible for compliance with applicable messaging laws (TCPA, etc.)
For Customers (Message Recipients)
- Customers opt in to receive project-related SMS messages (appointment reminders, project updates, and invoice notifications) through a dedicated consent form or verbal/written consent recorded by their contractor
- Consent is not a condition of purchase — you are not required to agree to SMS messaging to receive services from your contractor
- Message frequency varies based on project activity (typically 1–10 messages per month)
- Message and data rates may apply
- Reply STOP to any message to opt out
- Reply HELP for assistance, or email [email protected]
- Opting out of SMS does not affect your ability to view your project portal
SMS opt-in data and consent will not be shared with third parties for marketing or promotional purposes.
Carriers (including T-Mobile) are not liable for delayed or undelivered messages.
7. Your Data
You retain ownership of all data you enter into Chisel — customer records, project details, photos, invoices, and communications. We do not claim any intellectual property rights over your content.
You grant us a limited license to store, process, and display your data solely for the purpose of providing the Service. See our Privacy Policy for details on how we handle your data.
8. Availability & Support
We strive to keep Chisel available 24/7, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or data loss resulting from service interruptions.
9. Limitation of Liability
To the maximum extent permitted by law, Chisel and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.
11. Termination
We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or fail to pay for your subscription. You may close your account at any time by contacting us. Upon termination, your data will be deleted within 90 days unless retention is required by law.
12. Changes to These Terms
We may update these terms from time to time. If we make material changes, we will notify you via email or a notice within the platform. Continued use of the Service after changes constitutes acceptance of the updated terms.
13. Governing Law
These terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Michigan.
